Welcome to Islandflicks. These Terms & Conditions outline the agreement between Islandflicks ("we", "us", "our") and the client ("you") when booking photography and videography services.
By booking our services, making payment, or confirming a project, you agree to these Terms & Conditions.
1. Booking & Confirmation
A booking is considered confirmed once:
The client has accepted the agreed quote or service package; and
Any required deposit or payment has been received.
Until payment is received, dates and availability remain subject to change.
Islandflicks reserves the right to decline or cancel bookings where necessary.
2. Payments
Payment terms will be agreed before the project begins and stated on the invoice.
Unless otherwise agreed:
A deposit may be required to secure your booking date.
The remaining balance must be paid according to the agreed payment schedule.
Final images, videos, or deliverables may not be released until full payment has been received.
Late payments may result in delays to editing and delivery.
3. Cancellation & Rescheduling
If you need to cancel or reschedule your booking, please contact Islandflicks as soon as possible.
Deposits are generally non-refundable as they secure your date and cover preparation time.
Where possible, Islandflicks may offer a rescheduled date subject to availability.
If Islandflicks must cancel due to unforeseen circumstances, we will provide an alternative date where possible or refund any payments made for services not provided.
4. Photography & Videography Services
Islandflicks will provide services as agreed in the selected package, quote, or invoice.
The final creative outcome may vary due to factors outside our control, including:
Lighting conditions
Weather
Location restrictions
Venue rules
Guest behaviour
Event schedules
Islandflicks will always aim to deliver work that reflects our creative style and professional standards.
5. Editing & Delivery
Editing and post-production are included as part of our service.
Delivery times will depend on the type and scale of the project and will be communicated before or after the shoot.
Islandflicks reserves the right to extend delivery times during busy periods or due to circumstances outside our control.
6. Image & Video Selection
Where applicable, Islandflicks will make the creative selection of final images and footage.
RAW files, unedited images, and project files are not included unless specifically agreed.
The final delivered work represents Islandflicks' professional editing style and creative judgement.
7. Copyright & Usage Rights
Copyright of all photographs, videos, and creative work remains with Islandflicks unless otherwise agreed in writing.
Clients receive personal or agreed usage rights for the final delivered content.
You may not:
Sell the images/videos
Modify the work significantly
Claim ownership of the creative work
Use content commercially without permission
Commercial usage rights can be discussed separately.
8. Portfolio & Social Media Usage
Unless otherwise agreed, Islandflicks reserves the right to use selected photographs and videos for:
Portfolio purposes
Website display
Social media
Marketing materials
If you do not wish your images/videos to be used publicly, please inform us before the project begins.
9. Client Responsibilities
The client is responsible for providing accurate information regarding:
Event details
Locations
Timings
Access requirements
Special requests
Islandflicks is not responsible for missed coverage caused by incorrect information provided by the client.
10. Events & Coverage Limitations
For events, Islandflicks cannot guarantee coverage of every individual moment, person, or request.
Our coverage is dependent on:
Available time
Venue restrictions
Guest cooperation
Event schedule
We recommend clients communicate any important moments they would like prioritised.
11. Equipment Failure & Unforeseen Circumstances
Islandflicks takes every precaution to protect your content.
In the unlikely event of equipment failure, data loss, illness, or circumstances beyond our control, we will make every reasonable effort to recover, replace, or complete the service.
Our liability is limited to the value of the services paid for.
12. Liability & Damage
Islandflicks takes all reasonable care when providing photography and videography services. However, we cannot be held responsible for circumstances outside of our reasonable control, including but not limited to venue restrictions, weather conditions, guest behaviour, equipment limitations, or unexpected events.
The client is responsible for ensuring that Islandflicks has safe and reasonable access to the location and working environment. The client may be liable for any loss, damage, or injury caused by the client, guests, contractors, or other individuals attending the event.
Islandflicks accepts no responsibility for damage caused to equipment where such damage results from the actions, negligence, or interference of the client, guests, venue staff, or third parties.
Where Islandflicks equipment is damaged, lost, or made unusable due to the actions of the client or persons under the client's responsibility, the client may be responsible for reasonable repair or replacement costs.
13. Safety & Working Conditions
Islandflicks reserves the right to refuse or stop work if conditions become unsafe, including situations involving dangerous environments, threatening behaviour, or circumstances that may risk personal safety or equipment damage.
The client is responsible for informing Islandflicks of any relevant restrictions, hazards, or access requirements before the project begins.
14. Client Data & Privacy
Client information is collected only for the purpose of providing photography and videography services.
Personal information will not be shared with third parties unless required by law or necessary to deliver the service.
15. Agreement
By booking Islandflicks, you confirm that you have read, understood, and agreed to these Terms & Conditions.
